SECTION 802 Terms of Service

These Terms govern the use of SECTION 802 provided by Yuta Asano, trading as A-Ovnel (the “Operator”).
1. Application
These Terms apply to all use of the Service. Pricing, guides, and notices form part of them. A negotiated agreement prevails if inconsistent. A person acting for an organization represents that they have authority.
2. Service
SECTION 802 supports repeatable checks through checklist creation, sharing, execution, page rules, and run history. Features and limits depend on the plan. It does not guarantee completeness, legal compliance, or prevention of incidents.
3. Registration
Users register by agreeing to these Terms and the Privacy Policy. The Operator may reject or suspend registrations involving false information, abuse, serious prior violations, organized crime, or operational risk.
4. Accounts and credentials
Users must protect credentials and must not lend, transfer, or improperly share them. Actions with valid credentials are normally treated as the account user's actions. Sessions or tokens may be revoked for security.
5. Workspaces and teams
Owners and administrators manage members, roles, and sharing. The Operator normally does not intervene in internal disputes. Owners must have authority over contracting and billing.
6. Free trials
Trial duration, eligibility, and limits are shown at sign-up. Abuse, duplicate use, or breach of conditions may end a trial.
7. Paid subscriptions
Prices, billing cycles, and conditions are shown before purchase. Monthly and annual subscriptions renew automatically until canceled. Cancellation takes effect at period end. No prorated or unused-period refund is provided unless required by law.
8. Team pricing
Team charges are based on billable seats and a minimum seat count. Seat changes during a term may create prorated Stripe adjustments.
9. Payment
Payments are handled by Stripe or another stated method. Failed payments may be retried. Continued non-payment may result in view-only access or suspension.
10. Price changes
Prices may change for reasonable reasons. Material adverse changes for existing users will be announced with reasonable notice, allowing cancellation before they apply.
11. Referrals and Credit
Referral conditions are displayed in the Service. SECTION 802 Credit is non-transferable and not redeemable for cash. Abuse, self-referral, or duplicate accounts may invalidate benefits.
12. User Data
Rights in User Data remain with the user or rights holder. Users grant the Operator a non-exclusive right to process it as needed to provide, maintain, and improve the Service. User Data is not sold for advertising.
13. Third-party information
Users must obtain any consent, authority, or other lawful basis required before entering another person's information.
14. Prohibited conduct
Users must not violate laws, commit crimes, infringe rights, impersonate others, gain unauthorized access, distribute malware, overload the Service, scrape it at scale without permission, perform unauthorized security testing, evade technical or billing controls, improperly share credentials, unlawfully reverse engineer, disrupt operations, or support organized crime.
15. User responsibilities
Users must adapt checklists to their work, avoid relying solely on the Service for important decisions, avoid entering passwords or API keys into answers, and export important data when appropriate.
16. Safety-critical use
The Service is not designed for direct life or bodily control, medical decisions, aviation, rail, nuclear, or comparable safety-critical uses. Users choosing such use must implement independent safeguards.
17. Intellectual property
Intellectual property in SECTION 802, its UI, software, and design belongs to the Operator or the relevant rights holder.
18. Feedback
Product feedback may be used without compensation to improve the Service, excluding personal and confidential information.
19. External services
The Service uses providers such as Cloudflare, Stripe, and Resend. Their outages, changes, or discontinuation may affect the Service.
20. Service changes
Features or specifications may change for reasonable reasons. Material adverse changes will be announced in advance where practicable.
21. Suspension of service
The Service may be suspended for maintenance, security response, cloud outages, disasters, cyberattacks, or force majeure.
22. Suspension and termination
The Operator may suspend or terminate use for breach, non-payment, fraud, security risk, legal request, or material misrepresentation.
23. Cancellation by users
Users may cancel through the stated process. Access normally continues to the end of the paid term. Subscription cancellation and account deletion are separate.
24. Account deletion
Account deletion normally has a 30-day grace period and may be deferred for unresolved billing or Team-owner duties. Personal data is deleted; shared Team business records may be retained after identifiers are removed or replaced.
25. Data retention
Run history is normally kept for 365 days on Personal and 730 days on Team and Enterprise. It may be deleted without individual notice after expiry. Users needing longer retention must export it.
26. Disclaimer of warranties
To the extent permitted by law, the Operator does not warrant uninterrupted availability, freedom from errors, compatibility with every browser or site, fitness for a purpose, complete accident prevention, legal evidentiary value, permanent storage, or continuity of third-party services.
27. Liability
Except for willful misconduct, gross negligence, or mandatory law, liability is limited to ordinary direct loss and excludes lost profit and indirect, special, or consequential loss. Aggregate liability is capped at the greater of fees actually paid in the preceding six months or JPY 10,000. Mandatory consumer law prevails.
28. User indemnity
To the extent permitted by law, users must reimburse reasonable loss and cost arising from third-party claims caused by their intentional or negligent breach or infringement.
29. Confidential information
User Data is handled under the Privacy Policy. Any additional confidentiality obligation must be agreed separately.
30. Changes to these Terms
These standard terms may be changed where reasonable in light of users' general interests, the contract purpose, necessity, and proportionality. The change and effective date will be announced by a reasonable method.
31. Notices
Notices may be delivered in the Service, by registered email, or by another reasonable method.
32. Assignment
Users may not assign their contractual position without consent. The Operator may transfer contracts as part of a business succession in accordance with law.
33. Severability
If part of these Terms is invalid, the remaining provisions continue in effect.
34. No waiver
A delay in exercising a right is not a waiver of that right.
35. Governing law and jurisdiction
Japanese law governs. Except where mandatory jurisdiction applies, the district or summary court having jurisdiction over the Operator's principal place of business has exclusive first-instance jurisdiction.
36. Language
The Japanese version is authoritative. This English translation is for convenience and, subject to mandatory law, the Japanese text prevails.
